DATES OF SWEEPSTAKES/ENTRY PERIODS: The “2025 Ultimate Flying Giveaway” (the “Sweepstakes”) begins at 12:00 a.m. Eastern Time (“ET”) on July 21, 2024 and ends at 11:59 p.m. ET on May 31, 2025 (the “Sweepstakes Period”). The Sweepstakes Period is subject to eleven (11) monthly entry periods (each, an “Entry Period” or “Month”).  For each Entry Period, one (1) first prize winner (“First Prize Winner”) will be selected at random as outlined in the “WINNING/NOTIFICATION” section herein (each, a “Monthly Drawing”). At the end of the Sweepstakes, one (1) grand prize winner (“Grand Prize Winner”) will be selected. The eleven (11) Entry Periods and Monthly Drawing dates are:

There is a limit of one hundred (100) entries per person for this Sweepstakes. Non-winning eligible entries from previous Entry Periods will carry over and will be considered eligible for subsequent Monthly Drawings.  All valid Entries received will be eligible for the Grand Prize drawing.  See “WINNING/NOTIFICATION” section for details.

ELIGIBILITY: The Sweepstakes is open only to permanent legal residents of the fifty (50) United States or the District of Columbia who are at least eighteen (18) years of age or the age of majority in their jurisdiction of residence at the time of entry (each, an “Entrant”). The Entrants who are selected as the First Prize Winners and Grand Prize Winner must have a unique, personal and valid social security number for Sponsor to report the tax liability associated with acceptance of the respective Prize. Valid social security numbers will be determined by Internal Revenue Service (“IRS”) requirements as further defined in the “PRIZE CLAIMS” section of these Official Rules. 

Officers, directors, managers and employees of Sponsor, and each of their respective parent companies, subsidiaries, affiliates, and related companies, dealers, distributors, advertising and Sweepstakes agencies, consultants and agents, as well the immediate family (spouse, parents, siblings and children) and household members of each such person, and any others engaged in the development, production, execution or distribution of this Sweepstakes, including National Sweepstakes Company, LLC (the “Independent Administrator”) are not eligible to participate.  Sweepstakes is subject to all federal, state and local laws and regulations. Sweepstakes is void outside the fifty (50) United States, the District of Columbia and wherever else restricted or prohibited by law.  By entering this Sweepstakes, Entrants indicate their full and unconditional agreement to, and acceptance of, these Official Rules and the decisions of the Sponsor and/or Independent Administrator, which are final and binding in all respects. Winning a Prize is contingent upon fulfilling all requirements set forth herein.

HOW TO ENTER: There are three (3) ways to enter the Sweepstakes as described below, personal magazine subscription, gift subscription, or by mail (via the alternate method of entry, or “AMOE”). Regardless of the method(s) used to enter, there is a limit of one hundred (100) entries per Entrant during the Sweepstakes Period. Non-winning eligible entries from previous Entry Periods will carry over and will be eligible for subsequent Entry Periods.

Subscription: There are two (2) ways Entrants can enter via subscription. 

The five (5) Qualifying Magazines are:

Existing Subscribers: If you are an existing subscriber (subscribed prior to the start of this Sweepstakes), you will receive one (1) entry for each Qualifying Magazine you are subscribed to for Entry Period 1.  Such entry will continue to be eligible for each Monthly Drawing held thereafter, including the Grand Prize drawing. 

New Subscribers:  If you become a subscriber to a Qualifying Magazine during the Sweepstakes Period, the associated entry will be eligible for the Monthly drawing associated with the Entry Period for which you subscribed.  Such entry will continue to be eligible for each Monthly drawing held thereafter, including the Grand Prize drawing.

In order for entries to be considered valid for a Monthly Drawing, the Entrant’s account must be “Active”, meaning, the account must be paid for, and the Entrant must be receiving the monthly subscription. Entrants who cancel their subscription prior to May 31, 2025 will no longer be considered “Active” and the associated entry will not be considered valid for participation in this Sweepstakes.

The first twenty-five (25) envelopes submitted will each equal one (1) entry into the sweepstakes. The twenty-sixth (26th) envelope submitted will equal seventy-five (75) entries into the Sweepstakes. The entries will be eligible for the Monthly drawing associated with the Entry Period for which the envelope was postmarked. Such entries will continue to be eligible for each Monthly drawing held thereafter, including the Grand Prize drawing. A maximum of twenty-six (26) envelopes may be submitted via this method.

Regardless of the method(s) used to enter this sweepstakes, there is a limit of one hundred (100) entries per Entrant, even if more than one hundred (100) entries were earned. In the event of a dispute regarding the identity of the person who submitted a subscription, gift subscription or purchase, the entry will be deemed submitted by the Authorized Account Holder (defined below) of the e-mail address connected with the email account from which the purchase was made (or the email address listed on the 3”x5” card within an AMOE envelope). “Authorized Account Holder” is defined as the natural person who is assigned to an e-mail address by the Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. An Entrant may be requested to provide Sponsor with proof that the Entrant is the Authorized Account Holder of the email address associated with the entry. Any attempt by any Entrant to enter this Sweepstakes using multiple/different accounts or any other methods may void the Entrant’s entries and may result in disqualification, at the sole discretion of Sponsor. Use of any automated system to participate in the Sweepstakes is prohibited and may result in disqualification. The Sweepstakes Entities are not responsible for any entry that is lost, late, misdirected or  undeliverable, whether due to system errors, omissions, interruptions, deletions, defects, delays in operation or transmissions or any other reason, theft or destruction or failures, faulty transmissions or other telecommunication malfunctions, entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, technical malfunctions, or otherwise. Late entries or entries sent via any other method than those stated above will not be accepted. For AMOE Entrants: Multiple entries submitted by a single Entrant in the same envelope or exceeding the entry limit above will not be considered eligible. Entries submitted or completed by anyone other than the Entrant are void. No mechanical reproductions will be accepted.  Sponsor will not verify receipt of entries for Entries.  All entries submitted by mail become the sole property of the Sponsor and will not be returned. Sponsor is not responsible for lost, late, misdirected, illegible, damaged or postage-due mailed entries. 

WINNING/NOTIFICATION: There are two (2) ways to win Prizes in this Sweepstakes:

Notification: Prize Winners will be notified by the Independent Administrator via email within approximately three (3) business days from the date in which the drawing takes place. Each Prize Winner must complete and return “Required Documents’ as outlined in the “PRIZE CLAIMS” section below.  First Prizes will be shipped within four (4) to six (6) weeks from the date in which the respective First Prize winner was confirmed.

Each of the drawings will be conducted by the Independent Administrator whose decisions are based upon their sole discretion and interpretation of these Official Rules and are final and binding in all respects.

PRIZE CLAIMS:  Except where prohibited, all Prize Winners will be required to complete, execute and return an Affidavit of Eligibility, Liability and Publicity Release (the “Release”) and an IRS Form W-9 (“W-9 Form”) and any other documents required by Sponsor, (collectively, the “Required Documents”) within seven (7) days or less from receipt of notification from the Independent Administrator by email. If a potential Prize Winner fails to return the Required Documents within the time period required, or if the email is returned as undeliverable, such potential Prize Winner forfeits his/her right to the Prize and an alternate will be notified as outlined in the “WINNING/NOTIFICATION” section above, even if the disqualified potential Prize Winner’s name may have been publicly announced. Potential Prize Winners must report income to the IRS. In the event it is deemed during the verification process that a potential Prize Winner does not have a unique, personal and valid social security number for Sponsor to report the tax liability associated with acceptance of the Prize, such potential Prize Winner will be disqualified, and an alternate will be notified as outlined above.  Valid social security numbers will be determined by IRS requirements. If it is determined by the Sponsor, in its sole discretion, that a potential Prize Winner is not eligible or otherwise not in compliance with these Official Rules, the potential Prize Winner forfeits his/her right to the Prize and an alternate will be notified as outlined in the “WINNING/NOTIFICATION” section above, even if the disqualified potential Prize Winner’s name may have been publicly announced.  In the event a potential Prize Winner is disqualified for any reason, Sponsor/Independent Administrator shall have no liability or obligation to such individual. Sponsor will make three (3) attempts to determine prize winners for this Sweepstakes via alternate winner selection (if applicable) after which, any unclaimed prizes will go unawarded.

PRIZES:  The total approximate retail value (“ARV”) of all prizes available to be won in this Sweepstakes is: $111,000.00 broken down as follows:

Grand Prize:  One (1) Grand Prize will be awarded in this Sweepstakes, inclusive of Grand prize Winner’s choice of one (1) of the following:

In accepting the Credit, Grand Prize Winner understands and agrees that, notwithstanding the extent of the experience and skill of the pilot, owning and operating an aircraft is an inherently dangerous activity that may result in permanent injury, property damage, dismemberment or even death and associated liabilities.  By way of illustration only, hazards include inclement weather, equipment failure and myriad unanticipated exigencies during launch. To the fullest extent permitted by law, Grand Prize Winner assumes all such risks.

Without limiting any other release contained herein and to the fullest extent permitted by law, Grand Prize Winner releases, indemnifies and agrees to hold harmless Sponsor and Independent Administrator from any and all liability for any injury, death or property damage arising (directly or indirectly, in whole or in part) from ownership and/or operation of the aircraft purchased with the Credit. The preceding includes not only any injury or loss suffered by the Grand Prize Winner him/her/themselves but also by any third party, including passenger(s) on the aircraft.   

In awarding the Credit to Grand Prize Winner, Sponsor and Independent Administrator are directly relying on Grand Prize Winner’s representation that he/she/they fully understands the risks of owning and operating an aircraft and accepts those risks as of the date the aircraft is purchased.

In accepting the Credit, Grand Prize Winner further understands and agrees that (a) he/she/they will assume full responsibility for any and all diligence in the selection and purchase of an aircraft and (b) Sponsor and Independent Administrator have not obtained any insurance for the benefit of Grand Prize Winner nor have they conducted any diligence on the nature, quality and condition of the airplanes available for sale on the www.aircraftforsale.com platform.

Credit Details: If accepting the Credit, Grand Prize winner agrees to take all actions reasonable and necessary to ensure the aircraft selected and purchased is in good working condition and to conduct all reasonable inspections and servicing (i.e. having the aircraft inspected by a licensed and qualified inspector that is familiar with the make and model of the aircraft and components prior to delivery). Grand Prize Winner is expected to comply with all applicable federal, state and local laws, rules and regulations, including but not limited to licensing and insurance regulations required to maintain an aircraft in his/her/their possession. Unless otherwise stated herein, the sales tax, title and licensing of the aircraft is the sole responsibility of the Grand Prize Winner. Grand Prize Winner will be solely responsible for any applicable registration, and insurance fees and any other expenses not listed herein related to receipt, possession, acceptance and use of the Grand Prize. 

Any aircraft purchased with the Credit will be delivered solely with the express written limited warranties set forth in the Aircraft’s applicable Owner’s Guide, which warranties shall run for the term set forth in said guide. Grand prize Winner acknowledges that neither Sponsor nor the Independent Administrator nor the Sweepstakes Entities have made nor is in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to the Grand Prize described herein, including, but not limited to, its quality, merchantability, mechanical condition or fitness for use. All warranties for the Grand Prize are hereby disclaimed by Sponsor and the Grand Prize Winner will accept the Grand Prize “as is.” Grand prize Winner is solely responsible for all applicable taxes (including, without limitation, sales tax and income tax), insurance costs, surcharges, registration, title, license fees, storage, and any other costs incurred in claiming, registering or using the aircraft.

The depiction of the Grand Prize in any advertising or promotional materials or physical display may not be or reflect the actual Grand Prize awarded and delivered to the Grand Prize Winner. Any difference between the stated ARV of the Grand Prize and the actual value of the Grand Prize at the time for which it is awarded will not be awarded.  The Grand Prize is taxable as income and Grand Prize Winner is solely responsible for any taxes on the Grand Prize, including, but not limited to all applicable federal, state and local taxes.

First Prizes: One (1) First Prize will be awarded for each Monthly Drawing. The ARV of each First Prize is $1,000.  A total of eleven (11) First Prizes will be awarded in the Sweepstakes.  The total ARV of all First Prizes to be awarded is $11,000.  Each First Prize Winner will receive a prize of Sponsor’s sole choosing, which may include (subject to availability) items and or gift cards from partner brands, or ecommerce stores.

Names of prize manufacturers are used solely for the purposes of identification of the Prize.  No sponsorship, authorization or endorsement is intended or implied by such use.

No substitution of Prizes is permitted except at Sponsor's discretion. Prizes are not transferable and may not be resold.  Sponsor reserves the right to substitute a prize of equal or greater value.  No more than the Prizes set forth in these Official Rules will be awarded. Prize Winners are required to comply with any and all applicable federal, state and local laws, rules and regulations. Any taxes imposed on the income of a Prize Winner as a result of winning a Prize and all other expenses not specifically mentioned herein as part of the Prize are solely the responsibility of the Prize Winner. No transfer or substitution of Prizes is allowed except at the sole discretion of the Sponsor. Sponsor is not responsible for and will not replace any lost, stolen or misplaced Prize. Any depictions of the Prizes in advertising are for illustrative purposes only and may not represent the actual Prize awarded. No more than the number of Prizes set forth in these Official Rules will be awarded.  All Prizes will be awarded.

Each Prize Winner consents (and agrees to sign any additional documents required by Sponsor, to formalize, effect or perfect such consent, except where prohibited by law) for Sponsor and those acting under their authority, to use his/her name, likeness (photograph and/or video), biographical information, and voice in advertising/publicity/trade without territorial or time limitations and without compensation, notice or approval; and, each Prize Winner disclaims any ownership rights of such advertising/publicity/trade material. Sponsor and Independent Administrator are not responsible for any change of email address, mailing address and/or telephone number of Entrants. 

GENERAL CONDITIONS:  Should any portion of the Sweepstakes be, in Sponsor’s  sole discretion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole discretion of the Sponsor, corrupts or impairs the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes and conduct the Sweepstakes in a manner which in its sole discretion is fair, appropriate and consistent with these Official Rules. Notice of such action by Sponsor will be posted at www.flyingmag.com (the “Website”).  In such event, Sponsor reserves the right to award the Prizes at random from among the non-suspect entries received up to the time of the impairment.  Sponsor reserves the right in their sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Sponsor reserves the right to disqualify or reject any incomplete, inaccurate or false entry.  ANY ATTEMPT BY ANY PERSON TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. SPONSOR'S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THESE PROVISIONS.

RELEASE: By participating in this Sweepstakes, Entrants agree to release and hold harmless Sponsor and each of its respective officers, directors, managers, employees, parents, subsidiaries, affiliates, agents, members, shareholders, insurers, servants, divisions, distributors, predecessors, successors, representatives, dealers, distributors, advertising, Sweepstakes, and fulfillment agencies, including the Independent Administrator, consultants and legal advisors (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes  or receipt, redemption or use of a Prize, including any travel related thereto, if applicable.

LIMITATIONS OF LIABILITY:  The Released Parties are not responsible for (a); unauthorized human intervention in any part of the entry process or the Sweepstakes; (b) electronic or human error which may occur in the administration of the Sweepstakes or the processing of entries; (c)  any injury or damage to persons or property, which may be caused, directly or indirectly, in whole or in part, from Entrant's participation in the Sweepstakes;  (d) any printing or typographical errors or other incorrect or inaccurate entry information in any Sweepstakes-related materials; (e) stolen, lost, late, misdirected, corrupted, incomplete, or indecipherable entries; or (f) technical failures of any kind, including but not limited to the malfunctioning of any computer, mobile device, cable, network, hardware or software.

ENTRANTS PERSONAL INFORMATION: Information collected from Entrants is subject to Sponsor’s privacy policies, located at https://firecrown.com/privacy-policy/. If you are selected as a Prize Winner, your first name, last initial, city, and state will also be included in a publicly-available winner’s list and (if desired by Sponsor), on social media channels, the Website and via email to subscribers.

WINNER’S LIST / OFFICIAL RULES REQUEST: For the name of the Prize Winners or a copy of these Official Rules, please submit a self-addressed, stamped envelope for receipt by July 31, 2025 to “2024-2025 Flying Magazine Giveaway” (please specify Winners List or Official Rules Request), PO Box 458, Newark, NY, 14513. A copy of these Official Rules may also be obtained at the Website during the Sweepstakes Period.

This Sweepstakes shall not be published without the written permission of the Sponsor.
